Transparency, Confidentiality and Access to Information


Transparency in the work of the Accreditation Body of Montenegro (ATCG) is ensured pursuant to the Law on Accreditation, the Decision on Establishment and the Statute of ATCG. With a view to informing interested parties, ATCG regularly publishes on its official website information of general interest, including the legal and regulatory framework governing accreditation and the establishment of ATCG, information on its activities and operations, accreditation criteria and procedures, the register of accredited conformity assessment bodies together with details of their scope and validity of accreditation, the schedule of accreditation fees, as well as other relevant information relating to accreditation, the functioning of ATCG and the national accreditation system.

Confidentiality of Information

In accordance with the Statute of ATCG, documents, information and data of significance for the work of ATCG or relating to its activities, the disclosure of which could result in harm or adverse consequences to the institution or to conformity assessment bodies participating in the accreditation process, shall be deemed confidential.

Confidential information includes:

  • Documents, information and data designated as confidential by the competent bodies of ATCG;
  • Documents, information and data owned by conformity assessment bodies to which ATCG gains access in the course of the accreditation process.

Such information may be disclosed to third parties solely with the prior consent of the competent body of ATCG or of the respective conformity assessment body, unless disclosure is required by law or pursuant to a court decision.

Permanent employees of ATCG, members of its governing, advisory and technical bodies, as well as externally engaged individuals and entities, are required to maintain the confidentiality of data and information to which they have access in the course of performing their duties or carrying out activities for ATCG.

Mechanisms for the Protection of Confidentiality

ATCG has established and consistently applies appropriate mechanisms to safeguard the confidentiality of information and data, in particular those obtained in the course of the accreditation process. These mechanisms include, but are not limited to:

  • The requirement for all employees, members of governing, advisory and technical bodies, as well as externally engaged individuals and entities, to sign a Declaration on Confidentiality and Compliance with the ATCG Code of Ethics;
  • The conclusion of a legally binding Accreditation Agreement with conformity assessment bodies, pursuant to which ATCG undertakes, inter alia, to treat as confidential all information and data obtained during the accreditation process;
  • The conclusion of a legally binding Contract for Engagement in Assessment Activities with assessors and technical experts for each individual accreditation assessment, pursuant to which, inter alia, the engaged assessor or technical expert is obliged to maintain the confidentiality of all information and data obtained in the course of performing assessment activities;
  • The possibility for conformity assessment bodies to lodge a complaint concerning the work of ATCG in the event of a suspected breach of confidentiality, in accordance with the established complaints procedure.
Access to Information

In accordance with the Law on Free Access to Information, ATCG guarantees the right of access to information that has not been publicly disclosed, subject to the conditions and procedures prescribed by law.
